Begin by discussing your project with Planning staff. Submit the application and all required documentation for review. Staff will advise if any additional information is necessary. When complete, the application is presented by the Urban Development Director to the Board of Adjustment at their monthly meeting. The Board will decide to Approve; Approve with Conditions; or Deny the request.
If the application is approved, you may apply for a building permit. If the application is denied, you may appeal the decision within ten (10) days.
A Variance is a form of relief from the zoning ordinance to permit the use of land in a way that is not otherwise permitted under the ordinance. Variances are considered if the literal application of the Zoning Code would produce an unnecessary hardship on the landowner and rendering the property virtually useless.
Financial hardship is not applicable for consideration of a Variance.
