As required by Section 311, Title 25 of the Oklahoma Statutes, notice is hereby given that the City of Sapulpa, State of Oklahoma, will hold a regular meeting on Monday, December 19, 2005, at 7:00 p.m., at the Council Chambers, Sapulpa City Hall, 425 East Dewey, Sapulpa, Oklahoma.

MEETING PROCEDURE: Comments from the public are welcome at two different times during the course of the meeting: (1) Comments not scheduled on the Agenda will be heard under Public Comments - Agenda Item No. V.; and (2) Comments on all scheduled Agenda Items will be heard immediately following the presentation by staff or petitioner. Please wait until you are recognized by the Mayor and keep comments as brief as possible. The City Council will act on the Agenda Item after comments from the staff and the public has been heard.

PUBLIC COMMENTS: The purpose of the Public Comments Section of the Agenda is for members of the public to speak to the City Council on any subject not scheduled on the Regular Agenda. CONSENT AGENDA: All matters under "Consent" are considered by the City Council to be routine and will be enacted by one motion. Any City Council member may, however, remove an item from consent by request.

 

    A. Consider a motion approving Minutes of the regular City Council meeting of December 5, 2005.

 

    B. Consider approving Regular Claims in the amount of $683,082.80.

     

     

     

 

 

    C. Consider approving following Prepaid Claims

2. City Check #66508 dated December 6, 2005 for $850.00. Payable

CURRENT BUSINESS

 

A. Consider approving the request from the Dr. Martin Luther King, Jr.

Society for a temporary street closure and permit for a parade

honoring Dr. King, scheduled Saturday, January 14, 2006, at 10:00 a.m.

The following is the route for the proposed parade: Assemble at Booker

T. Washington Center. Proceed south on Gray Avenue, then east on

West Johnson Avenue. Turn south onto North Hickory, then turn east on

Dewey and proceed to Shaw Auditorium for program.

 

B. Consider approving the Final Plat and Irrevocable Letter-of-Credit for

Berry Park Estates Subdivision as per the Sapulpa Metropolitan Area

Planning Commission Case #FP-05-05, Creek County, Oklahoma or as

more particularly described by the metes and bounds description contained therein, accepting the Letter-of-Credit for the public

infrastructure item of water system and authorizing the Mayor/Vice-

Mayor to sign said.

A tract of land situated in the Southeast Quarter of the Northwest Quarter of the Northeast Quarter (SE/4 NW/4 NE/4) of Section 36, Township 18 North, Range 11 East of the Indian Base and Meridian, Creek County, State of Oklahoma. Said tract of land being more particularly described as follows: Beginning at the Northwest Corner of said SE/4; Thence North 88 deg. 46’ 01" E along the North line of said SE/4 a distance of 662.84 feet to the Northeast Corner of said SE/4; Thence South 01 deg. 12’ 21" E along the East line of said SE/4 a distance of 661.81 feet to the Southeast Corner of said SE/4; Thence South 88 deg. 53’ 16" W along the South line of said SE/4 a distance of 661.85 feet to the Southwest Corner of said SE/4; Thence North 01 deg. 17’ 29" W along the West line of said SE/4 a distance of 661.50 feet to the Point of Beginning. Containing 10.061 acres more or less, according to the U.S. Government Survey thereof.

APPROVALS AND ACCEPTANCES

 

    A. Ordinances:

 

1. Consider adopting an Ordinance of the City of Sapulpa amending

the Employee Deferred Compensation Plan for the City of

Sapulpa, Oklahoma, providing for amendment to Article III,

Limitations on Amounts Deferred; providing for amendment to

Article IV, Benefit Distribution; and providing for amendment to

Article V, Rollovers to the Plan Compliance with Code Section

457 (b); providing for compliance with the Internal Revenue Model

Amendment Language; and providing for repealer and severability;

and declaring an emergency.

 

2. Consider adopting an Ordinance of the City of Sapulpa, changing

the Corporate Limits of the City of Sapulpa, Oklahoma, by

de-annexing certain contiguous tracts of land in Sections 5 and 6,

Township 18 North, Range 12 East, Creek County, Oklahoma,

from the city limits of Sapulpa, Oklahoma.

 

3. Consider adopting an Ordinance amending the zoning map of the

City of Sapulpa, changing the zone and district of land in the City

of Sapulpa Lots 21, 22, 23 and 24, in Block 11, Woodlawn

Addition to the City of Sapulpa, Creek County, State of Oklahoma,

requests to be rezoned from CS (Light Commercial) to CG

(Commercial General) as per SAZ-865, Creek County, Oklahoma,

and directing the City Clerk to show each change upon the official

zoning map; repealing all ordinances or parts of ordinances in

conflict herewith; and declaring an emergency.

 

4. Consider adopting an Ordinance amending the zoning map of the

City of Sapulpa; changing the zone and district of land in the

Sapulpa Southwest corner of Taft and Wickham Road AKA the

Northeast 10 acres of Lot One (1), (NE/4 NE/4) of Section Four

(4), Township Seventeen (17) North, Range Eleven (11) East of the

Indian Base and Meridian, Creek County, State of Oklahoma,

requests to be rezoned from AG (Agricultural) to CG (Commercial

General) as per SAZ-866, Creek County, Oklahoma, and directing

the City Clerk to show each change upon the official zoning map;

repealing all ordinances or parts of ordinances in conflict herewith;

and declaring an emergency.

 

    B. Resolutions:

 

1. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

amending the FY 2005-2006 Annual Budget by increasing revenues

and appropriations in the Grants and Aid Fund for the purpose of

providing funds for the recognition of Grant Award from the

Oklahoma Department of Wildlife Conservation to renovate the

Sahoma Lake covered fishing dock.

 

2. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

amending the FY 2005-2006 Annual Budget by increasing revenues

and appropriations in the Library Fund for the purpose of

appropriating funds received from donations and for the purchase of

software.

 

3. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

directing notice of proposed annexation into municipal limits of

certain territory located in Section 5, Township 18 North, Range 12

East, Creek County, Oklahoma; and authorizing and directing the

proper officials of the City of Sapulpa to implement such proceedings;

and declaring an emergency.

 

4. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

requesting assistance from the Oklahoma Department of Transportation

(ODOT) in regard to paving a lake access road to serve public lake

areas on Sahoma and Pretty Water Lakes.

 

5. Consider adopting a Resolution of the City of Sapulpa, Oklahoma, and

the Sapulpa Municipal Authority, Sapulpa, Oklahoma, amending the

FY 2005-2006 Series 2004 Capital Improvement Revenue Construction

Fund Budget to provide appropriations for a Change Order associated

with the Hobson Street projects.

 

    C. Bid Awards:

 

1. Consider rejecting all bids for a Fire Prevention House due to a

change in the available funds for the equipment from the 2004 Fire

Act Grant award, making it possible to fund a larger fire prevention

trailer, and directing staff to solicit bids for a larger fire prevention

trailer.

 

 

 

 

    D. Contracts:

 

1. Consider approving the Application for Credit with Economical

Research Management, Inc. (E.R.M.I.).

 

2. Consider approving Change Order No. 1 to Wickham Road

Elementary School Sanitary Sewer Extension Project contract

with R. L. Hensley Construction Company in the amount of

$14,929.71 to include the provision of sanitary sewer service to the

new development west of Wal-Mart.

 

3. Consider approving Change Order No. 2 to contract with Horizon

Construction, Inc. in the amount of $15,268.46 for work pertaining

to correcting drainage problem west of the Young Law Office and

east of the Library.
