As required by Section 311, Title 25 of the Oklahoma Statutes, notice is hereby given that the City of Sapulpa, State of Oklahoma, will hold a regular meeting on Monday, April 7, 2008 at 7:00 p.m., at the Council Chambers, Sapulpa City Hall, 425 East Dewey, Sapulpa, Oklahoma.

 

MEETING PROCEDURE:  Comments from the public are welcome at two different times during the course of the meeting:  (1) Comments not scheduled on the Agenda will be heard under Public Comments - Agenda Item No. V.; and (2) Comments on all scheduled Agenda Items will be heard immediately following the presentation by staff or petitioner.  Please wait until you are recognized by the Mayor and keep comments as brief as possible.  The City Council will act on the Agenda Item after comments from the staff and the public has been heard.

CONSENT AGENDA:  All matters under “Consent” are considered by the City Council to be routine and will be enacted by one motion.  Any City Council member may, however, remove an item from consent by request.

 

 

A.     Consider a motion approving minutes of the regular City Council meeting of March 17, 2008.

 

 

B.     Consider approving Regular Claims in the amount of $228,028.87.

 

 

C.     Consider approving following Prepaid Claims:

 

1.      Health Insurance Claims - $106,906.32

 

D.     Consider approving Payroll Claims in the amount of $332,935.72.

A.  Consider conducting a public hearing on the question of annexing into

      and de-annexing from municipal limits certain territory located in

      Sections 21, 28 and 33, Township 18 North, Range 12 East, Creek

      County, Oklahoma.

XI.

CURRENT BUSINESS

 

 

A.  Consider two temporary street closure requests from Sapulpa Main

      Street:

 

      1.  For a facade removal project at the Tyler Building, 19 East Hobson,

           on Friday, April 18th, 2008, from 8:00 a.m. to 5:00 p.m. Temporary                

           street closure will include Hobson Avenue from Main Street to Water

           Street.

 

      2.  The 19th Annual Route 66 Blowout Festival on Saturday, June 7th,

           2008, from 5:30 a.m. to 6:00 p.m.  Streets to be closed are as

           follows:  Dewey Avenue from Main Street to Walnut Street (at the

           traffic light).  Oak Street, Park Street and Water Street from Hobson

          Avenue to Lee Street.

 

B.     Consider a request for a temporary street closure from the Washington

Elementary School for their Career Day for Friday, May 9, 2008.  The

requested closure includes Lee Street between Maple and Walnut be

blocked off from 9:01 a.m. to 3:16 p.m.

 

C.  Consider temporary street closure request from American Heritage Bank

      for a workweek planned for volunteers to repair and refurbishing of art

      work, etc. at American Heritage Park for Monday, April 7th at 8:00 a.m.

      till 7:00 p.m. on Friday, April 11th, 2008.  The closure includes Poplar

      Street from Hobson to the northern boundary of the Sapulpa Library

      parking lot, located on the west side of Poplar.

 

 

D.  Consider approving the Final Plat for The Lakes at Jefferson Heights

      Phase I as per the SMAPC Case #FP-02-08, Creek County, Oklahoma,

      or as more particularly described as the North Half of the Southeast

      Quarter (N/2 SE/4) of Section 4, Township 17 North, Range 11 East,

      of the Indian Base and Meridian, Creek County, State of Oklahoma;

      and authorizing the Mayor to sign said plat.

 

E.      Consider acceptance of the Comprehensive Annual Financial Report and

Auditor’s Report for the fiscal year ended June 30, 2007.

 

F.  Consider confirming Mayoral appointments to the Sapulpa Preservation

     Commission as follows:

 

·         Frank Gierhart to a three year term with term expiring in

April, 2011.

·         Mary Jo Stansbury to a three year term with term expiring in

April, 2011.

 

·         Tami Fleak to a two year term with term expiring in April,

2010.

·         Doris Yocham to a two year term with term expiring in April,

2010.

 

·         Rick Engleman to a one year term with term expiring in April,

2009.

·         Cathy Bennett to a one year term with term expiring in April,

2009.

APPROVALS AND ACCEPTANCES

 

 

A.     Ordinances:

 

1.  Consider adopting an Ordinance amending the Zoning Ordinance

     of the City of Sapulpa, changing the zone and district of land in the

     City of Sapulpa, a tract of land located in the West Half of the

     Northwest Quarter of the Southwest Quarter of the Southwest

     Quarter of Section 36, Township 18 North, Range 11 East, Creek

     County, Oklahoma; rezoning said land from RS-3 (Residential Single

     Family High Density District) to RMT – (Residential Multi-Family

     Townhouse District).

 

 

 

 

2.  Consider adopting an Ordinance of the City of Sapulpa changing

           the Corporate Limits of the City of Sapulpa, Oklahoma, by De-

           annexing certain contiguous tracts of land in Section 4, Township 18

           North, Range 12 East, of the Indian Base and Meridian, Creek

           County, Oklahoma, from the City Limits of Sapulpa, Oklahoma, and

           declaring an emergency.

 

    3.   Consider adopting an Ordinance of the City of Sapulpa, Oklahoma,

         amending Chapter 11, Section 1140 of Article II of the Zoning

         Ordinance of the City of Sapulpa; providing for the purpose:  Defining

         Scope and Application of Nonconforming Lots Standards.

 

 

B.     Resolutions:

 

1.   Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

      approving and thereby authorizing the Mayor to execute a Project

      Agreement for installation of a traffic signal at Line Avenue and

      State Highway 97 (Federal-Aid Program, Project Number HSIPY-

      119C (117) TR, J/P #25033 (04) and approving the pre-payment

      of a deposit in the amount of $24,260 to the Oklahoma Department

      of Transportation (ODOT) as the City of Sapulpa’s estimated share

      of project costs.

 

2.  Consider a Resolution of the City of Sapulpa, Oklahoma, by

     amending the FY 2007-2008 Capital Improvements Fund and

     General Obligation Bond Construction Fund Budget by decreasing

     the Transfers from the Capital Improvements Fund to the General

     Obligation Bond Construction Fund to reflect a lower level of

     assistance needed to fund the Sapulpa (Country Club) Lake Spillway

     Improvements Project.

 

 

C.     Bid Awards:

 

 

      1.  Consider awarding the bid for Meter Replacement Parts (Brass) to

           Water Products of Oklahoma, Inc. as being the sole bid for a period

           of six months from date of award.

 

     2.  Consider awarding Water Distribution Materials and Supplies to the

          following vendors as being the lowest and most responsive bids:

 

         Water Products:

 

         Lot 1:  Items 1 through 19, 21 through 31

         Lot 2:  Items 1 through 127, 129 through 132, 134 through 138,

         140 through 169, 171 through 215, 219 through 230, 232 through 368.

     

 

 

 

         Pioneer Supply:

 

        Lot 1:  Item 20

        Lot 2:  Items 128, 133, 139, 170, 216, 217, 218 and 231

 

                      

D.      Contracts:

 

1.  Consider certificate of authorized signatures form with Oklahoma

     Department of Commerce (ODOC).

 

2.  Consider approving the First Amendment to Lease Agreement with

     SBC Tower Holdings, LLC, for cellular tower leasehold and

     authorize the Mayor to execute the same.

 

3.  Consider approving a First Addendum to Sanitary Sewer Extension

     and Development Agreement for the Jefferson Heights development

     and authorize the Mayor/Chairman to execute the same.

EXECUTIVE SESSION

 

 

A.     Consider entering into Executive Session to discuss the following:

 

1.  Discuss with legal counsel threatened and pending claim of

     Gary M. Wheeler and Jackie C. Wheeler alleged from

     construction activities during East Thompson Road Improvement

     Project.  [25 O.S. Section 307 (B) (4)];

 

  1. Consider action in open session regarding matters discussed in

Executive Session, including without limitation, the following:

 

1.  Consider approving and ratifying settlement agreement with

     Gary M. Wheeler and Jackie C. Wheeler to dispose of threatened

     and pending claim related to road construction activities.
