As required by Section 311, Title 25 of the Oklahoma Statutes, notice is hereby given that the City of Sapulpa, State of Oklahoma, will hold a regular meeting on Monday, March 6, 2006 at 7:00 p.m., at the Council Chambers, Sapulpa City Hall, 425 East Dewey, Sapulpa, Oklahoma.

MEETING PROCEDURE: Comments from the public are welcome at two different times during the course of the meeting: (1) Comments not scheduled on the Agenda will be heard under Public Comments - Agenda Item No. V.; and (2) Comments on all scheduled Agenda Items will be heard immediately following the presentation by staff or petitioner. Please wait until you are recognized by the Mayor and keep comments as brief as possible. The City Council will act on the Agenda Item after comments from the staff and the public has been heard.

A. Consider approving the final plat for Hickory Place Phase IV Subdivision as per the Sapulpa Metropolitan Area Planning Commission (SMAPC) Case #FP-01-06, Creek County, Oklahoma, or as more particularly described by the metes and bounds description contained therein, and authorizing the Mayor/Vice-Mayor to sign said plat.

APPROVALS AND ACCEPTANCES

 

A. Ordinances:

1. Consider adopting an Ordinance of the City of Sapulpa, Oklahoma,

amending the Sapulpa City Code Part 12, Planning Zoning and

Development, Chapter 1, Boards and Commissions, by adopting

and adding new Article A, Economic Development Department,

Section 12-101, providing for the creation of a Sapulpa Economic

Development Department; and adopting and adding new Article B,

Economic Development Advisory Board, Sections 12-110 through

12-114, providing for the creation of a Sapulpa Economic

Development Advisory Board; providing for board qualifications,

composition and term; and providing that if any part or parts of this

ordinance are held invalid or ineffective, the remaining portions shall

not be affected; and declaring an emergency.

 

2. Consider adopting an Ordinance of the City of Sapulpa, Oklahoma,

amending the Sapulpa City Code Part 7, Finance and Taxation, by

adding new Chapter 6, Hotel/Motel Tax, Sections 7-601 through

Section 7-629, all providing for the levying and assessing a sales tax

of five percent (5%) in addition to present sales taxes upon the gross

proceeds or gross receipts derived from rents received from

occupancy of hotel rooms; providing for use of tax funds; providing

for subsisting state tax permits; providing exemptions; providing for

certificates of exemptions; providing tax to be separately designated

on billing; providing for the administration and collection of tax;

requiring the filing of returns; providing for interest and penalties for

failure to pay tax when due; providing for taxpayer to keep records;

requiring operators to collect the tax; providing for discount;

authorizing the City Council to make administration and technical

changes and additions, except tax rates; making the tax cumulative;

providing severability of provisions; providing for payment of tax;

requiring bonds; providing for assessment and determination of tax;

providing for remedies; providing general powers for the treasurer;

requiring certificates of registration; providing for administrative fees;

making records confidential; providing penalty for fraudulent returns;

providing for payment of legal fees; requiring approval of ordinance by

majority of registered voters voting at an election held for such

purpose as provided by law; fixing effective dates; and providing for

severability.

 

 

B. Resolutions:

 

1. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

amending the FY 2005/2006 Street Improvement Sales Tax Fund

by increasing appropriations to provide for engineering services and

construction match on a manually operated traffic signal for

emergency vehicles entering onto New Sapulpa Road from the newly

constructed Fire Station No. 4.

 

2. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

amending the FY 2005/2006 Street Improvement Sales Tax Fund

Budget and the 2005/2006 Capital Improvement Fund Budget to

provide for additional Phase 2 Street Rehabilitation Design

Services and expenses associated with a Change Order on Lazy H

Drainage Project.

3. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

requesting financial assistance from the Oklahoma Department of

Transportation to construct a manually activated traffic signal on

New Sapulpa Road (SH-66) to provide for the safe exit of fire trucks

onto New Sapulpa Road when responding to emergency calls,

agreeing to 20% local match, agreeing to pay all engineering,

right-of-way and utililty relocation expenses and agreeing to

maintain the signal light after project completion.

 

4. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

amending the FY 2005/2006 Street Improvement Sales Tax Budget

by increasing appropriations to account for final cost of Phase I

Residential Street Rehabilitation Contract with PCSI, Inc., and to

restore funding for replacement of bridge on Interurban Avenue.

 

5. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

authorizing the calling and holding of an election in the City of Sapulpa,

State of Oklahoma, for the purpose of submitting to the registered,

qualified voters of said City the question of levying and collection of a

graduated city sales tax of five percent (5%) in addition to all other city

and state sales taxes levied or assessed upon the gross receipts derived

from rents received from occupancy of hotel or motel rooms to provide

revenues for encouraging, promoting and fostering conventions,

conferences and tourism development in the City of Sapulpa; promotion

of cultural, recreational, commercial, industrial, educational and

economic events or development for the City of Sapulpa and solicitation

of visitor attractions, events, tourism, conferences, conventions and

meetings in the City of Sapulpa.

 

6. Consider adopting a Resolution of the City of Sapulpa, Oklahoma,

amending the FY 2005/2006 Annual Budget by increasing revenues

and appropriations in the Library Fund for the purpose of appropriating

funds received from donations for the purchase of books and materials.

 

7. Consider adopting a Resolution of the City of Sapulpa, Oklahoma, and

the Sapulpa Municipal Authority, Sapulpa, Oklahoma, amending the

FY 2005/2006 Series 2000 CIP Revenue Construction Fund by

increasing appropriations to provide for engineering services to redesign

Wickham Road to conform to available budget resources.

 

8. Consider adopting a Resolution of the City of Sapulpa, Oklahoma, and

the Sapulpa Municipal Authority, amending the FY 2005/2006 CIP

Revenue Construction Fund by increasing appropriations to provide for

Surveying and Easement Procurement Services necessary for obtaining

the necessary right-of-way on Wickham Road, Teel Road (Phase 2) and

the Mission-Taft Signalization and intersection projects.

 

C. Bid Awards:

D. Contracts:

 

1. Consider approving agreement with Terracon for Geotechnical Exploration Services associated with Lake Sahoma Road (SH-66 to Line).

 

2. Consider approving Amendment No. 4 to agreement with The Benham Companies, L.L.C. dated 10/18/04 to provide for the redesign of Wickham Road to conform to available budget.

 

3. Consider approving Change Order No. 2 (Reconciliatory) to Phase I Street Rehabilitation Contract with PCSI, Inc. in the amount of $11,255.08 to adjust the final quantities used on the project.

 

4. Consider approving the Lease Agreement with Creek County Literacy Program, Inc. for the building located at 15 North Poplar, Sapulpa, Oklahoma, and authorize the Mayor to execute the same.

 

5. Consider approving the Supplemental Agreement No. 1 to the contract dated February 6, 2006, with Professional Engineering Consultants, P.A. (P.E.C.) for the Thompson Street Reconstruction Design in the additive amount of $23,753.00 making the total contract amount $55,026.00.
